Jack Five Jumps LLC Rental Agreement

In consideration of the Rental Equipment described on the invoice page of this Rental Agreement and General Release and in addition to all of the terms and conditions set forth on the previous page of this agreement, the parties do further agree as follows:

1. Identity of parties: For the purposes of this Rental Agreement, "Jack Five Jumps LLC", shall mean Jack Five Jumps LLC, its owners, officers, directors, employees, contractors, and agents. "Customer" shall mean the person(s) or company listed in the "Rented To" box on the invoice page of this agreement as well as the person signing the agreement (if different), and their agents and/or employees.

2. Equipment, Rent, Payment, and Term of Rental Agreement: Customer rents from Jack Five Jumps LLC certain equipment described on the invoice page of this agreement. The rental fee set forth is payable, in full, in advance, and the rental term shall be that listed as "Start Time" on the invoice page of this agreement, but all of customer's obligations arising under the terms and conditions of this Rental Agreement shall run from the actual delivery of the rental equipment to the actual pickup of the rental equipment by Jack Five Jumps Party Rental. If the equipment is delivered and accepted by customer, then the customer shall not be entitled to any refund whatsoever if customer elects not to use the equipment due to weather or other causes.

3. Return Check Policy: In the event that a check is returned to Jack Five Jumps LLC for insufficient funds, customer agrees to pay the total rental price as well as an additional $75.00 return fee. Checks are only accepted from businesses, churches, and schools. Other organizations please inquire before making a payment by check. Personal checks are not accepted.

4. Weather: Jack Five Jumps LLC cannot guarantee weather conditions, we reserve the right to cancel or reschedule you rental prior to delivery if severe weather conditions are immanent or if we have reason to believe that the equipment and/or its users may be in danger. Some examples of severe weather conditions are high winds, rain, snow, thunder, and/or lightning. In the event of severe weather during a rental, customer agrees that he/she/they will unplug the inflatable, allow it to deflate, and not use the equipment until severe weather ends.

5. Care of the Rental Equipment: Customer shall be responsible for any and all the damage to any of the Rental Equipment not caused by ordinary wear and tear. "Ordinary wear and tear" shall mean only the normal deterioration of the rental equipment caused by ordinary, reasonable and proper use of the rental equipment. Customer shall be liable to Jack Five Jumps LLC for any and all damage, which is not the ordinary wear and tear includes, but is not limited to, cutting or tearing of vinyl or netting, damage due to overturning, overloading, exceeding rated capacities, breakage, improper use, abuse, lack of cleaning, contamination of or dirtying of rental equipment with non-approval items such as chemicals, food, paint, silly string, mud, clay, or other materials.

6. Possession: Customers right to possession of the Rental Equipment begins upon the items being delivered to Customers premises and terminates on the actual pick up by Jack Five Jumps LLC. Retention of possession or any failure to permit the pickup of the equipment at or after the end of the"Rental period" specified constitutes a material breach of this agreement. In the event that the equipment is not returned for any reason, including theft, the customer is obligated to pay to Jack Five Jumps LLC the full replacement value for such equipment listed on the invoice page of this agreement, plus any and all incidental costs associated with the attempted pick up or recovery of the equipment by Jack Five Jumps LLC. Customer shall not cause nor permit these items, or any of them, to be sublet, rented, sold, or removed from the delivery address, or otherwise transfer such items. If rental items are not returned and/or levied upon for any reason whatsoever, Jack Five Jumps LLC may take possession of said items without further notice or legal process and use whatever force is necessary to do so. Customer hereby agrees to indemnify, defend, and hold Jack Five Jumps LLC harmless from any and all claims and costs arising from such retaking. If rental items are stolen, or otherwise moved from the delivery address, customer shall notify Jack Five Jumps immediately.
General Misuse: Do not allow riders to play or climb on walls, sides, or roof of inflatable. Please do not allow water or a water hose near a dry inflatable. If the inflatable should become wet, have an adult wipe down unit before Our Team return. Make sure the unit is not wet when picked up.
Negligence or Abuse: The following fees may be assessed for negligence or abuse of inflatable.
Spilled Food, drink or the uses of Silly String could result in a $100-$500 Cleaning Fee.
Negligence or damage to the unit(s) could result in a $500 - $15,000 Repair Fee.
If the unit is not repairable, a fee of $500 - $15,000 could result
If inflatable is not covered during rain (either a tarp or following verbal instruction) there will be a $100 drying/cleaning fee.
Any extreme mud or sand in or on unit could result in a $100 - $500 cleaning fee.
Any damage or altercation to water hoses will result in an automatic $20 charge to card on file.
Any use of soap, baby powder, baby oil, etc.. Will result in an automatic $100 cleaning fee.
7. Equipment problems: Should any equipment develop a problem, or does not function correctly at anytime, or Customer does not understand the operating instructions, the customer agrees to immediately cease use of the equipment. In particular, if the inflatable unit begins to deflate, customer will immediately have the riders exit the unit and then check for one of the following conditions: 1) The motor has stopped; in which case check the power cord connection at the outlet where the unit plugs in to make sure that it has not been unplugged; 2) If the motor continues to run, check for blockage of the air intake screen on the side of the blower unit. Also, check both air tubes on the back of the unit for snugness and tighten the ties if necessary; 3) If either of these steps corrects the problem, fully re-inflate the unit prior to permitting anyone to use the unit; 4) If you cannot correct the problem, call our office at (281)865-4647

8. Cancellation/Refund Policy: Jack Five Jumps LLC welcomes cancellations of any sort as well as re-schedules for future dates, however, Jack Five Jumps LLC provides no refunds and $50 booking fee is non-refundable. Jack Five Jumps provides a rain-check for six months of original booking date. A REFUND WILL NOT BE ISSUED for any other reason except inclement weather. The time period for weather cancellations will be judged on a case by case basis, but no later than 8AM the date of the rental to receive a refund. NO REFUND will be issued after the equipment has been delivered, even if the equipment is not used. A) If the equipment malfunctions or is inoperable, it is the sole responsibility of the customer to notify Jack Five Jumps LLC immediately. If Jack Five Jumps LLC is not notified and given a chance to correct the problem, NO REFUND will be issued. If Jack Five Jumps LLC arrives at scheduled rental location and cancellation takes place the customer will be charged $100 cancellation, labor at $25 per person, and mileage from our office to said rental location.

9. Customer Acknowledgement: Customer acknowledges and certifies that they have had sufficient opportunity to read this entire Agreement, and agree to be bound by all the terms and conditions on all pages and that they understand its content and that they execute it freely, intelligently, and without duress of any kind.

10. Entire Agreement: This Agreement constitutes the full Agreement between Jack Five Jumps LLC and Customer. Any prior agreements, whether written or oral, promises, negotiations or representations not expressly set forth herein shall be of no force or effect. Customer acknowledges the receipt of the Rental Equipment that is the subject of the Rental Agreement and General Release and the fact that it is in good working order.

Safety Rules

  1. This is the most important rule. A Responsible Adult Must Be In Attendance and Closely Supervise All Activity While Any Inflatable or Piece of Our Equipment is In Operation. You, the customer, are responsible for providing such supervision during the entire time that our party rental equipment is in your possession, unless Jack Five Jumps has explicitly agreed to provide this service.
  2. Do not use the inflatable or foam machines during periods of rain or excessive winds (20mph or greater). In the event of severe weather, (lightning, thunder, rain or high winds) instruct all occupants to immediately exit the inflatable and DO NOT allow re-entry until the weather clears.
  3. All Inflatables are physically challenging. Any person with a health impairment, disease, high blood pressure, back, neck or other bone/joint problems, or any other conditions that might cause problems when physically challenged should not be allowed in any of our inflatables.
  4. Remove shoes, eyeglasses, jewelry and other hard or sharp objects prior to entering inflatable.
  5. All participants should empty their pockets before entering the inflatable.
  6. No hot objects, pets, or toys are allowed in or near any inflatable.
  7. No Gum, No Face Paint, No Silly String, No Confetti, No Candy, Food or Drinks are allowed inside inflatable.
  8. No flips wrestling, or other forms of rough play are allowed in the inflatable.
  9. Do not overload any inflatable. Participants in a bouncer and generally all inflatables should be grouped according to age and size.
  10. Do not jump down any slide surface, climb on walls, or jump on entry step of inflatable.
  11. If anchors come loose, or should the inflatable begin to deflate during operation, immediately and calmly instruct all participants to exit the inflatable and call us at 281.865.4647.

The use of photography or video before, during or after contracted rental within this contract may be used in any marketing materials, social media or advertising

YARD CARD RENTAL AGREEMENT

Life is difficult enough these days. Jack Five Jumps Party Rental Yard Cards are designed to be celebratory, sweet and fun. We will not install a display containing disrespectful language.

Damage/Theft:

  • You are responsible for the protection of the rented Yard Cards and installation materials. A fee of $15 per letter or up to $50 per graphic will be charged if the Cards are damaged or stolen.
  • Do not tape or tie anything to the yard cards including balloons or streamers. Need another stake? Let us know, let us know ahead of time and we may be able to accommodate your request at no additional cost.

Payment Prior to Delivery:

  • Your order is confirmed once payment has been received. If the payment isn’t received by 24 hours PRIOR to the requested date, our installation team will not be scheduled and you will NOT receive your rented sign.

Approval:

  • You are responsible for gaining approval from any authority such as HOA, management or neighborhood board. If the display must be removed for any reason prior to its schedule pickup time, please contact usto make arrangements; an additional $15 re-delivery fee will be charged.

Delivery, Design and Placement:

  • If for any reason, the signsneeds to be re-delivered or picked up at a different time, an additional $15 re-delivery fee will be charged. Double check the address to be sure it is accurate.
  • Provide us with a gate code, if needed. If we are unable to access the delivery, an additional $15 re-delivery fee will be charged.

    Our Installation Team will choose colors, letters and graphics based on the information you provide. Designs and placement are at our discretion. We do our best to select items that reflect the interest/hobbies listed on the reservation form. However, we cannot guarantee certain designs or flair graphics. To avoid damage, repositioning or removing our signs is prohibited.


    We deliver in the late evenings or early mornings. Consider advising the recipient’s household member or watchful neighbors know we will be in your yard, often in the dark.

Yard Maintenance:

  • Do not mow, edge or trim while your the cards is displayed. The sign material will get stained. Schedule your yard crew the day before the delivery.
  • Water the yard before the Jack Five Jumps Yard Card installation team arrives; this makes installation go more quickly and smoothly.
  • Be sure the yard sprinklers are off PRIOR to our arrival, as well as on the rental day. If we cannot access the yard, an additional $15 delivery fee will be charged so that we can return to complete the installation.

Animals:

  • For sanitary purposes:
    • Clear the yard of any pet droppings prior to the installation.
    • Do not allow animals to relieve themselves on the Yard Card.
    • OUR TEAM WILL NOT INSTALL IF THERE IS PET DROPPING WHERE THE SIGN WILL BE INSTALLED AND NO REFUND WILL BE GIVEN
  • Aggressive animals that do not allow for the safe installation of your Signs may require us to cancel the installation

Safety

  • Do not allow people to play near the Display. We want you to Tag & Brag on social media, just please be safe so no one gets hurt.

Weather
:

  • In the event of inclement weather, we may not be able to install your cards safely. Inclement weather includes storms, heavy rain, high winds, snow, hail or any other Acts of God that put us or our display in harm’s way. We will attempt to reschedule.

Soft Play Rental Agreement

Release and Waiver of Liability
This is a legal document between the client “The Renter” and “Jack Five Jumps LLC”, which affects your legal rights, so please read carefully.
The Renter desires to rent soft play equipment from Smiles for Miles to be used by Renter, his/her guests, invites or other persons while in Renter's possession. Renter understands the use of this soft play equipment may, by its nature, cause injury or harm to Renter, his/her guests, invites, or other persons. The Renter does hereby freely, voluntarily, and without duress executes this Release under the following terms:

  1. Waiver and Release: Renter understands and acknowledges that this Release discharges Jack Five Jump, LLC from any liability or claim that the Renter may have against Jack Five Jumps LLC with respect to any bodily injury, personal injury, illness, death or property damage that may result from Renters use and possession of Jack Five Jumps LLC soft play equipment. Renter does hereby release and forever discharge and hold harmless Jack Five Jumps LLC and its successors and assigns from any and all liability claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Renters possession and use of Jack Five Jumps soft play equipment.

  2. Insurance: Renter understands that insurance for liability, health, and medical or disability coverage in any way related to the rental of equipment under this agreement is the sole responsibility of Renter.

  3. Indemnification: Renter agrees that he/she will indemnify and hold Jack Five Jumps LLC harmless from any liability resulting from the use of Jack Five Jumps LLC equipment by Renter, his / hers assigns, heirs, guests, invites or other persons using the equipment while in Renter’s possession.

  4. Set Up: Renter is responsible for clearing all areas needed for equipment. Jack Five Jumps LLC WILL NOT set up if there is dog waste, debris, unleveled area, gravel, dirt or Renter's tent is not set up. In addition, space must be measured before delivery day and furniture moved BEFORE Jack Five Jumps LLC arrival. Our team will not set up if there is a domestic dispute, animal disturbance or disruption to allow us to set up quickly and safely. The customer will be charged a DELIVERY FEE of $75 - $150 and the play area will NOT be delivered.
  5. Delivery: Renter must be present at the time of delivery and pick up. Please refer to confirmation email with delivery time to assure Renter is present. Jack Five Jumps LLC can wait for a total of 15 minutes. We will not wait if Renter is not home or available for scheduled delivery. If equipment is left unattended, Renter is responsible for damaged or stolen items. Jack Five Jumps LLC will not issue a refund if we are not able to deliver at scheduled time.

  6. Reservation: At the time of booking, a $50 payment along with signed rental agreement will be required to secure your requested date. The remaining balance will be due 5 days prior to your event. Failure to pay the balance will result in cancellation of the event and $50 payment will be lost.
  7. Reschedule: Should you feel the need to reschedule your reservation, please contact us as soon as possible. We require a minimum 24 hour notice and will allow you to reschedule for any reason within 6 months. We will not accept a request to reschedule on the day of delivery.

  8. Weather Conditions: If the Renter is hosting an outdoor event the Renter assumes all weather related risks. The Renter must have an indoor back up plan. Jack Five Jumps LLC will not set up the equipment outside if there is a chance of rain. We will not issue a refund if we are not able to set up due to weather conditions on the day of the event. Our team will deliver to another location within 5 miles of scheduled delivery location.

  9. Equipment Cleaning Care: To reduce the number of germs and spread of disease or illness, we ask that you immediately use disinfecting wipes on any equipment that has met the following situations: Leaked or soiled diapers, vomit, blood or mucus.

  10. Other: Renter expressly agrees that this Release is intended to be as broad and inclusive as permitted by laws of the State of Texas and that this Release shall be governed by and interpreted in accordance with the laws of the State of Texas. Renter agrees that in the event that any clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable.
  11. NO smoking on or around the soft play area.
  12. NO barbecues around the soft play area.
  13. DO NOT move soft play equipment, bounce house, tent or bumper car arena.
  14. NO shoes, sneakers, flip flops, sandals or heels.
  15. NO face paint, make-up or glitter.
  16. SOCKS must be worn at all times.
  17. All balls must be in ball pool at pick up time to avoid additional charges.
  18. NO food, candy, gum or beverages in the play area.
  19. All toys must remain in the play area.
  20. NO pushing, shoving, wrestling, horseplay or piling.
  21. NO more than the recommended number of toddlers at one time.
  22. All sharp objects must stay out of play area.
  23. NO pets in or around the play area.

Toddler Inflatable Rental Agreement (if applicable)

  1. Participants no more than 65 lbs. are allowed to use the Inflatable.
  2. No food, drink or chewing gum on or around the Inflatable. This will avoid a choking risk and keep the unit clean. (Please note if the Inflatable is collected in a dirty condition then the person hiring it will incur a cleaning charge of no less than $50.00)
  3. No face paints, party poppers, colored streamers or silly string to be used either on or near the Inflatable. (Please note these products will cause damage to the Inflatable that cannot be repaired)
  4. NO smoking on or around the Inflatable
  5. NO barbecues around the Inflatable
  6. Climbing, hanging or sitting on walls is dangerous and must not be allowed.
  7. A responsible adult must supervise the inflatable at all times.
  8. Always ensure that the Inflatable is not overcrowded, and limit numbers according to the age and size of children using it. Try to avoid large and small children from using it at the same time.
  9. Ensure Children are not pushing, colliding, fighting or behaving in a manner likely to injure or cause distress to others.
  10. No pets, toys or sharp instruments on the inflatable at anytime.
  11. Do not allow anyone to bounce on the front safety step as this is dangerous
  12. Do not allow anyone to be on the inflatable equipment during inflation or deflation as this is DANGEROUS.
  13. Please ensure that children are not attempting somersaults and are clothed appropriately and that nothing can fall out of their pockets.
  14. In the event that the blower stops working, please ensure all users get off the inflatable immediately and calmly. Check the fuses and make sure the blower tube or deflation tube has not come undone or something has not blown onto and is obstructing the blower. In the event that it overheats, or loses power, turn it OFF and unplug the power cord from the socket. Please contact us immediately.
  15. In the event of rain, high winds, or any other bad weather conditions which prevents us from setting up the inflatables, the client may reschedule for another day.
  16. This contract and agreement shall be in accordance with and governed by the laws of the State of Louisiana. And if, in fact lawsuit is brought, it shall be filed at the Harris County Courthouse.
  17. Maximum Weight of each group that should play in the bouncer at one time is: White Castle Bounce House - 13ft x13ft , maximum weight of 800 LBS; For 10ft x 10ft toddler bouncers, maximum weight of 300 LBS;
  18. The MOST IMPORTANT RULE: DO NOT let children play on the inflatable without adult supervision. Adult supervision is necessary to enforce these rules for safe operation of the inflatable and children.
  19. Please turn inflatable off when not in use.

Mini Bumper Car Rental Agreement (if applicable)

  1. Participants no more than 65 lbs. are allowed to use the mini bumper cars.
  2. Adult supervision is required at all times.
  3. Recommended age is 1.5 - 5 years.
  4. No food, drink or chewing gum on or around the bumper car arena.
  5. No face paint, party poppers, colored streamers or silly string to be used either on or near the arena.
  6. Anyone with broken bones or existing neck or back problems should not ride.
  7. Shirts and shoes must be worn while riding.
  8. No smoking, eating or drinking in the Mini Bumper Car Arena.
  9. Keep feet and hands inside the vehicle.
  10. Whenever in the car - STAY SEATED.
  11. Fasten seat belt before moving in the car.
  12. If car malfunctions or battery fails, please recharge and contact us ASAP.
  13. Failure to follow the rules will result in termination of use.
  14. No Refunds! All persons using this do so at their own risk.
  15. The remote control with helpful tips must remain in clear plastic bag.
  16. The customer will pay the fee of $900 to replace the Bumper Car Arena if it is damaged.

Canopy Tent Rental Agreement (if applicable)

  1. Do not move canopy tent.
  2. Canopy tent is used for soft play area only

Liability Disclaimer

  • This rental equipment has been received in good condition and will be returned in the same condition (ordinary wear and tear accepted)
  • Customer assumes all responsibility for injuries to persons or damages to property, and agrees to hold Jack Five Jumps harmless for any and all claims, damages, losses and expenses, directly, indirectly or consequently arising out of any or all injuries, of any kind, that occur during the rental period, when the Toddler Bounce House is in the possession of the customer/lessee.
  • Customer grants the company right to enter premises of customer at anytime to repossess said equipment.
  • Customer agrees not to loan, sublet or otherwise dispose of equipment or use it at any other location.
  • Customer agrees to pay in full the replacement cost, including labor, for all damages to rental equipment.
  • For any and all litigation or arbitration, arising out of this agreement, Jack Five Jumps LLC, shall be entitled to recover all cost incurred, including reasonable attorney’s fees. If the soft play equipment is lost, stolen, or damaged beyond repair the renter agrees to pay up to $3,000.00 (Three thousand dollars and 0 cents) If the inflatable equipment is lost, stolen, or damaged beyond repair the renter agrees to pay up to $3,000.00 (Three thousand dollars and 0 cents). If the canopy tent is lost, stolen, or damaged beyond repair the renter agrees to pay up to $400.00 (Four hundred dollars and 0 cents) If the mini bumper car is lost, stolen, or damaged beyond repair the renter agrees to pay up to $200.00 (Two hundred dollars and 0 cents) If the mini bumper car arena is lost, stolen, or damaged beyond repair the renter agrees to pay up to $1,200.00 (Twelve hundred dollars and 0 cents)

THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED.

The person/s or organization renting this Inflatable equipment will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever. I have read the above agreement and fully understand and accept the Conditions as above. I am aware that while in my care I am fully responsible for the soft play area including all toys, play mats and gates, inflatable, canopy tent, mini bumper cars and will pay for any loss or damages that may occur.

By signing below you agree to follow all rules stated above for the equipment you are renting. Furthermore you agree to terms laid out in the liability disclaimer section.
